When Is Spyware Not Spyware?

TWI has written an interesting piece about Anti-Spyware service providers such as ZoneLabs being sued by ‘legitimate’ companies for treating their programs and services as spyware. TWI asks what I think is a very interesting question:
If a business model is based on hiding pieces of software in users’ computers, to delivers advertisements and track them while using their computers, should the law take their side? How far goes our right to control what’s going on with our computers?
I personally am very protective about what is installed on my computer and I don’t even like auto-updaters installing on my machines, much less spyware. But one man’s spyware is another man’s useful app – who decides where the line is drawn?
