Apple's core os team has several of the key ZFS team members from Sun, who fled Sun for Apple when the meltdown was imminent. Also, the creator of BeFS, a 64 bit journaled filesystem from the mid 90's, when neither 64 bit or journaled were buzzwords yet.

I have a feeling they'll be alright. There comes a point with an unreasonable license where you look around the table and realize you can pay your guys to do it for less. In this case, Apple definitely has the right guys to do the job. Expect a new filesystem for OS X by the time 10.7 is ready to ship.
